By accessing or using CineTrak ("the Service"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and CineTrak. If you do not agree to these Terms, you must not access or use the Service in any way.
You must be at least 13 years of age to use CineTrak. By using the Service, you represent and warrant that you are at least 13 years old. If you are under the age of 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. CineTrak does not knowingly collect personal information from anyone under the age of 13, and if we become aware that a user is under 13, we will promptly terminate their account and delete any associated data.
CineTrak is a personal movie tracking application available on iOS, Android, and the web. The Service allows users to discover, organize, and keep track of the movies they watch. Key features of CineTrak include:
CineTrak is provided free of charge. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We may also introduce new features, impose limits on certain features, or restrict access to parts of the Service at our sole discretion.
To access the full range of features offered by CineTrak, you are required to create an account. You may register using your email address and a password, or by signing in through a supported third-party authentication provider such as Apple or Google.
You are responsible for maintaining the confidentiality of your account credentials, including your password, and for all activity that occurs under your account. You agree to use only one account per person and not to share your login credentials with any other individual. CineTrak will not be liable for any loss or damage arising from your failure to safeguard your account information. You acknowledge that you are fully responsible for all actions taken through your account, whether or not authorized by you.
You agree to use CineTrak only for lawful purposes and in a manner consistent with these Terms. When using the Service, you must not:

CineTrak allows you to create and share content such as movie reviews, ratings, watchlists, and curated collections ("User Content"). You retain full ownership of any User Content you create and submit through the Service.
By posting User Content on CineTrak, you grant us a non-exclusive, worldwide, royalty-free, transferable license to use, display, reproduce, and distribute your User Content solely for the purpose of operating, providing, and improving the Service. This license allows us to show your reviews and ratings to other users within the app, but we will not sell your User Content to third parties or use it for purposes unrelated to the Service.
You are solely responsible for the User Content you post. You represent and warrant that your User Content does not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party. CineTrak reserves the right to review, edit, or remove any User Content that violates these Terms, is deemed inappropriate, or is otherwise objectionable, without prior notice and at our sole discretion.
CineTrak displays movie information, images, trailers, and other media sourced from third-party providers. Movie metadata, including titles, synopses, release dates, and cast information, is provided by The Movie Database (TMDB). Movie poster images, backdrop images, and trailer videos are sourced from their respective rights holders and made available through third-party APIs.
CineTrak does not own, control, or claim any rights over third-party content displayed within the Service. All third-party content is subject to the terms and conditions of its respective owners and providers. We make no representations or warranties regarding the accuracy, completeness, or reliability of any third-party content. Your use of third-party content accessed through CineTrak is at your own risk.
The CineTrak brand, name, logo, visual design, user interface, app layout, and all underlying source code are the proprietary property of CineTrak and are protected by applicable intellectual property laws. All rights not expressly granted to you under these Terms are reserved by CineTrak.
You may not copy, reproduce, modify, adapt, distribute, create derivative works from, publicly display, or otherwise exploit any of CineTrak's intellectual property without our prior written permission. Unauthorized use of CineTrak's intellectual property may result in legal action.
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. CineTrak expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, secure, or available at any particular time or location. We do not guarantee that any defects or errors in the Service will be corrected in a timely manner or at all. The accuracy and completeness of movie information displayed within the Service depends on third-party data sources, and we are not responsible for any inaccuracies, omissions, or outdated information provided by those sources.
CineTrak is not responsible or liable for any content, products, or services offered by third parties that may be accessed through or linked from the Service. Your interactions with any third-party services are solely between you and that third party.
To the fullest extent permitted by applicable law, CineTrak and its owners, operators, officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of, or inability to use, the Service. This includes, without limitation, damages for loss of data, loss of profits, loss of goodwill, or any other intangible losses, even if CineTrak has been advised of the possibility of such damages.
In no event shall CineTrak's total aggregate liability to you for all claims arising out of or relating to the Service exceed the total amount you have paid to CineTrak in the twelve months preceding the claim. Since CineTrak is a free service, this amount is zero dollars ($0) for users who have not made any payments.
CineTrak reserves the right to suspend or permanently terminate your account at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms, is harmful to other users, or is otherwise detrimental to the Service or to any third party.
You may delete your account at any time by navigating to Settings within the app and selecting the Delete Account option. Account deletion is permanent and cannot be undone. Upon termination or deletion of your account, your personal data will be removed in accordance with our Privacy Policy. Certain data may be retained as required by law or for legitimate business purposes such as fraud prevention.
CineTrak reserves the right to modify or replace these Terms at any time. When changes are made, we will update the "Last updated" date at the top of this page. Your continued use of the Service after any changes to these Terms constitutes your acceptance of the revised Terms.
For material changes that significantly affect your rights or obligations, we will make reasonable efforts to notify you through the app, such as via an in-app notification or a prominent notice on our website. It is your responsibility to review these Terms periodically to stay informed of any updates.
These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or your use of the Service shall be resolved through appropriate legal channels in a jurisdiction of competent authority.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms shall remain in full force and effect.
